Terms of Service

Top Unturned Servers (the "Service") is operated by:

"We", "us" and "our" mean the above. "You" means the person using the Service.

Consumers and businesses are treated differently. You are a consumer if you are an individual acting outside your trade, business, craft or profession, and a business user otherwise. Several sections below limit our liability or your remedies more strictly for business users. Nothing in these Terms removes or limits a right a consumer has under mandatory law, and where a term would do so, it does not apply to that consumer — the rest of these Terms continue to apply.

These Terms, together with our Privacy Policy, are the whole agreement between us about the Service. They are available in English; that version governs.

You must be at least 15 years old to create an account. If you are under 18, you may only use the Service — and in particular may only make a purchase — with the permission of a parent or guardian, who is responsible for it.

You must not use the Service if you are subject to sanctions that prohibit it, or if we have previously terminated your account.

By creating an account on Top Unturned Servers, you authorize us to send essential service-related messages such as notifications, warnings, newsletters, account verification to the discord account, steam account or email address you provide.

You may opt out of non-essential communications at any time through your Account Settings.

Advertising & Promotional Communications

We send promotional, marketing or advertising messages about Top Unturned Servers only where you have agreed to receive them, or where you have bought something from us and the message is about our own similar services — which the law permits, and which you can stop at any time.

We do not need, and do not ask for, your agreement to marketing as a condition of creating an account or making a purchase. Every marketing message contains a one-click way to stop receiving them, and you can also turn them off in your Account Settings. Turning them off never affects the service you have paid for.

Marketing on behalf of unrelated third parties is only sent with your separate, explicit agreement.

Such communications may be delivered through:

• Email
• Website notifications
• Discord direct messages (if you connect or interact with our Discord services)
• Other contact methods you voluntarily provide

Where you link a Discord account, we use direct messages for service-related notices — for example confirming a purchase, warning that Premium is about to run out, or telling you a subscription payment failed. These are part of providing the service and are sent on that basis, subject to Discord's own policies. Promotional messages via Discord are sent only where you have agreed to them.

Essential service-related messages may still be sent even if you opt out of promotional communications, because we need them to perform our contract with you — but you can avoid them entirely by closing your account.

Payments are currently processed through PayPal or other payment providers we may support in the future. By purchasing a paid feature or subscription, you agree to comply with the applicable terms and policies of the payment processor used for your transaction.

By using our platform, you grant us permission to periodically connect to your server for verification, monitoring, and listing purposes. You confirm that the server you add is an Unturned server and that you are its owner or have authorization from the owner.

You agree not to upload, publish, or distribute the following content:

• Pornographic content
• Illegal content
• Racist, hateful, or discriminatory content

Top Unturned Servers allows users to register and log in using third-party authentication providers, including but not limited to Steam and Discord.

By signing in through Steam or Discord, you authorize Top Unturned Servers to access certain account information made available by those platforms, which may include your username, unique platform ID, avatar, and other publicly available profile data.

If you choose to link your Discord account to your Steam account for platform features, you expressly consent to the association of those accounts within our system.

You acknowledge and agree that:

• We are not affiliated with, endorsed by, or sponsored by Steam or Discord.
• Your use of Steam and Discord is subject to their respective terms and policies.
• We are not responsible for actions taken by Steam or Discord, including account suspensions, restrictions, or service interruptions.

We may store and process authentication-related identifiers for account management, security, and service functionality.

In the future, Top Unturned Servers may allow registration through email and password authentication. By registering via email, you agree to provide accurate and complete information and to maintain the security of your login credentials.

Top Unturned Servers may offer optional paid features including Sponsored Server Slots, premium placements, and subscription-based services.

All paid features require advance payment.

Discord Premium is sold in three ways. One is a one-off purchase of 30 days. It does not renew, nothing is stored on file, and when the days run out Premium simply switches off; you can buy it as many times as you like and the days are added to whatever is left. The other two are recurring subscriptions: a monthly one, where PayPal charges the stated amount once a month, and a yearly one, where PayPal charges the stated amount once a year. Both continue for an indefinite period until you cancel. There is no minimum term and no cancellation fee.

Cancelling a subscription. You can cancel at any time from the Premium manager on this site, or directly from the automatic payments section of your PayPal account. Cancelling stops all future payments. It does not shorten the period you have already paid for: Premium stays active until the end of that period, and your settings are kept.

If a payment cannot be collected, PayPal reattempts it over the following days and we notify you. If every attempt fails the subscription ends and Premium runs out at the end of the period you last paid for. Nothing further is charged.

The price you see is the total price you pay. Prices are shown in euro. We are not registered for VAT, so no VAT is added and none is shown separately. Nothing is added at checkout — no fees, no taxes, no surcharges. Your own bank or PayPal may apply a currency conversion charge if your account is not in euro, which is between you and them.

We may change the price of future purchases at any time. A change never applies to a purchase already made; for an active subscription, we will notify you before a new price takes effect and you may cancel before it does.

Failure to pay subscription fees may result in suspension or removal of paid features without notice.

We reserve the right to suspend or terminate premium features or subscriptions without prior notice in cases including, but not limited to:

• Fraud or attempted fraud
• Chargebacks or payment disputes
• Abuse of our services
• Violation of these Terms of Service

Paid features are provided on a best-effort basis.

Although we strive to provide continuous availability, we do not guarantee that premium services will operate without interruption, errors, maintenance, or downtime.

Temporary outages, maintenance periods, software bugs, third-party failures, network issues, or circumstances beyond our reasonable control do not entitle users to refunds, credits, compensation, or extensions unless otherwise required by applicable law.

Premium services are provided on an "as available" basis.

We make reasonable efforts to maintain service availability but do not guarantee uninterrupted operation.

Premium features may become temporarily unavailable due to:

• Maintenance
• Software updates
• Infrastructure failures
• Third-party service outages
• Network interruptions
• Game updates or API changes
• Force majeure events

Such interruptions shall not constitute a breach of these Terms and do not create any entitlement to refunds, credits, damages, or compensation, except where required by applicable law.

Top Unturned Servers provides a Raid Alerts plugin, which may be offered in both free and premium versions.

The free version provides raid alert notifications to all eligible players on participating servers.

The premium version includes additional functionality, including permission-based raid alerts that allow server owners to grant raid alert access only to players with permissions configured by the server owner.

Raid alerts may also be delivered to Discord channels through Discord webhooks or other Discord integrations configured by the server owner.

We do not guarantee:

• 100% uptime or uninterrupted availability
• Instant or real-time notification delivery
• Delivery of every raid alert
• Successful delivery of Discord notifications
• Compatibility with every server configuration, plugin, or mod
• Compatibility with future updates to Unturned, UBridge, RocketMod, OpenMod, Steam, Discord, or other third-party software or services

Top Unturned Servers shall not be liable for missed alerts, delayed notifications, failed Discord notifications, webhook failures, technical failures, service interruptions, plugin conflicts, data loss, in-game losses, or any direct or indirect damages resulting from the use or inability to use the Raid Alerts plugin.

The Raid Alerts plugin and its features may be modified, updated, temporarily unavailable, or discontinued at any time without prior notice and without liability.

Top Unturned Servers may provide a Suspect Alerts feature that sends notifications to Discord channels when a player is identified as potentially suspicious or exhibiting behavior that may indicate cheating.

Suspect Alerts are intended solely as an informational and administrative tool. Alerts are generated using configurable detection methods and should not be considered definitive proof that a player has cheated or violated server rules.

We do not guarantee:

• Detection of every cheating player
• That every suspect alert is accurate
• The absence of false positives or false negatives
• Successful delivery of Discord notifications
• 100% uptime or uninterrupted availability
• Compatibility with future updates to Unturned, UBridge, RocketMod, OpenMod, Steam, Discord, or other third-party software or services

Top Unturned Servers is not responsible for administrative actions taken by server owners or staff based on Suspect Alerts, including warnings, kicks, bans, or other disciplinary measures.

Top Unturned Servers shall not be liable for missed alerts, delayed notifications, failed Discord notifications, false positives, false negatives, webhook failures, technical failures, or any damages arising from the use or inability to use the Suspect Alerts feature.

The Suspect Alerts feature may be modified, updated, temporarily unavailable, or discontinued at any time without prior notice and without liability.

Top Unturned Servers may provide an Inactive Staff Alerts feature that sends notifications to Discord channels when staff members have been inactive for a configurable number of days.

The inactivity period, notification settings, and staff tracking are determined by the server owner's configuration.

We do not guarantee:

• Detection of every inactive staff member
• Accurate inactivity calculations under all circumstances
• Successful delivery of Discord notifications
• 100% uptime or uninterrupted availability
• Compatibility with future updates to Unturned, UBridge, RocketMod, OpenMod, Steam, Discord, or other third-party software or services

Top Unturned Servers shall not be liable for missed alerts, delayed notifications, failed Discord notifications, webhook failures, inaccurate inactivity calculations, technical failures, service interruptions, or any damages resulting from the use or inability to use the Inactive Staff Alerts feature.

The Inactive Staff Alerts feature may be modified, updated, temporarily unavailable, or discontinued at any time without prior notice and without liability.

Top Unturned Servers may provide downloadable plugins through our platform, including but not limited to those available at https://topunturned.com/plugins.

By downloading, installing, or using any plugin provided by Top Unturned Servers, you acknowledge and agree that:

• All plugins are provided "as is" without any guarantees of performance, stability, or compatibility.
• You install and use plugins entirely at your own risk.
• We are not responsible for any server issues, including but not limited to crashes, instability, data loss, performance degradation, misconfigurations, or unexpected behavior.
• We are not responsible for any direct or indirect damages, including server downtime, player loss, or financial loss resulting from plugin usage.
• We do not guarantee that plugins will be error-free, secure, or continuously maintained.
• Server owners are solely responsible for complying with all applicable privacy and data protection laws relating to any player information they collect or access through our plugins.
• Any access granted by a server owner to moderators, administrators, developers, Discord bots, Discord servers, web panels, or other third parties is the sole responsibility of the server owner.
• Top Unturned Servers acts only as a software provider and shall not be responsible for how server owners or their authorized personnel use player information.
• Features that send notifications through Discord depend on Discord's availability, webhook functionality, permissions, API behavior, and other third-party services. Top Unturned Servers does not guarantee the successful or timely delivery of Discord notifications and is not liable for failures caused by Discord or other third-party services.

You are solely responsible for properly configuring, testing, and maintaining your server environment when using any of our plugins.

Top Unturned Servers reserves the right to update, modify, or discontinue any plugin at any time without notice or liability.

All plugins provided by Top Unturned Servers are the exclusive intellectual property of Top Unturned Servers unless otherwise explicitly stated.

By downloading or using any plugin, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the plugin solely for personal or commercial use on your own Unturned server(s).

You agree that you will NOT:

• Copy, reproduce, distribute, or publicly share the plugin files in any form
• Sell, resell, sublicense, lease, or commercially exploit the plugins
• Modify, reverse engineer, decompile, or attempt to extract source code
• Upload or redistribute the plugins on other websites, marketplaces, or platforms
• Claim ownership or authorship of the plugins

Any unauthorized use, reproduction, or distribution of the plugins constitutes a violation of these Terms and may result in:

• Immediate termination of your account and access to services
• Permanent banning from the platform
• Legal action, including claims for damages
• Filing of DMCA takedown notices against infringing content

We actively monitor and enforce our intellectual property rights to the fullest extent permitted by law.

Continued use of our plugins constitutes acceptance of these licensing terms.

Sponsored Slots are paid promotional placements that provide enhanced visibility within server listings.

By purchasing a Sponsored Slot, you acknowledge that:

• Placement improves visibility only
• We do not guarantee increased player traffic, votes, player counts, popularity, engagement, search ranking, revenue, or any other business or gameplay outcome.
• We do not guarantee revenue, player growth, or engagement

Sponsored placements may rotate, change layout, or be adjusted at our discretion.

No refunds will be provided based on performance expectations, traffic levels, or player count results.

We reserve the right to remove any server listing at any time, with or without reason.

You may delete your server listing at any time via your server dashboard panel.

Intentionally falsifying player counts or artificially inflating server statistics is strictly prohibited.

Vote manipulation is not permitted. Servers found engaging in vote manipulation may be blocked, removed, or permanently blacklisted.

Vote manipulation includes, but is not limited to:

• Using VPNs, proxies, or similar tools to cast multiple votes
• Using bots, scripts, or automated systems to generate votes

By you. You may stop using the Service and delete your account at any time. If you have a subscription, monthly or yearly, cancel it first so that no further payment is taken.

By us, for cause, with immediate effect. We may suspend or terminate your account or any part of the Service immediately where you have materially breached these Terms — including anything in Chargebacks, Fraud & Abuse — where we are required to by law, or where continuing would expose us or other users to serious risk. We will tell you the reason unless doing so would defeat the purpose of the measure or is legally prohibited.

Where we terminate for cause, Premium time obtained through the breach is forfeited and is not refunded.

By us, for any other reason. We may also withdraw the Service, or stop providing it to you, for our own reasons — for example if we discontinue a feature or the Service entirely. In that case we will give you reasonable notice where practical, and we will refund the unused portion of anything you have already paid for, calculated pro rata from the date the Service stops being available to you.

Termination does not affect rights and obligations that have already accrued, or any section of these Terms that is intended to survive it — including liability, indemnity, dispute resolution and the chargeback provisions.

To the fullest extent the law allows, the Service is provided "as is" and "as available", and we exclude all warranties, conditions and terms implied by statute or common law.

In particular, we do not promise that: the Service will be uninterrupted, timely, or free of bugs, errors, delays or security vulnerabilities; that any feature will remain available; that data reported by game servers, third-party APIs or plugins is accurate; that alerts, notifications or detections will be delivered, delivered in time, or correct; or that the Service will meet any particular requirement of yours.

The Service is provided for the operation and promotion of game servers. It is not designed or suitable for any use where failure could cause death, personal injury, or financial or other serious loss, and you must not rely on it for such a use.

If you are a consumer: nothing above affects your legal rights to receive digital content and digital services that conform to the contract. If what we supply is faulty or not as described, you are entitled to have it brought into conformity, or to a proportionate price reduction or a refund, as the law provides. Tell us and we will deal with it.

What we never exclude. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for damage caused intentionally or by gross negligence, under mandatory product liability law, or for anything else that cannot lawfully be limited. These carve-outs are stated first because a clause that tried to exclude them would be void in its entirety, and the rest of this section would go with it.

Subject to that, we are not liable for: loss of profits, revenue, goodwill, players, rankings or business opportunity; loss or corruption of data; server downtime; business interruption; or any indirect or consequential loss — whether or not we were told such loss was possible. This applies to free and paid parts of the Service alike, including Raid Alerts, Suspect Alerts, Inactive Staff Alerts, plugins and Sponsored Slots.

We are not liable for anything caused by: a third-party service we depend on (Discord, Steam, PayPal, Unturned itself, hosting or network providers); changes to the Unturned game; the acts or omissions of a server owner or their staff; or your own configuration, including which features you switch on and who you give access to.

Cap. Subject to the carve-outs above, our total liability arising out of or in connection with the Service — in contract, tort (including negligence), or otherwise — is limited to the total amount you actually paid us in the twelve months before the event giving rise to the liability. If you paid us nothing in that period, our liability is limited to €50.

Business users. If you are not a consumer, you additionally agree that any claim must be brought within one year of the date you became aware, or ought reasonably to have become aware, of the facts giving rise to it, and that the exclusions above apply to the fullest extent permitted between commercial parties.

Consumers. If you are a consumer, this section applies only so far as the law allows. Your mandatory statutory rights, including the conformity rights described above, are unaffected, and we remain liable for foreseeable loss caused by our failure to use reasonable care and skill.

You are responsible for what you put on the Service and what you do with it — including your server listing, descriptions, images and links, the configuration you choose, and how you and your staff handle player data you obtain through our plugins or bot.

If a third party brings a claim against us because of something you did or failed to do — for example content you published that infringed someone's rights, or your misuse of player data — you will compensate us for the losses, damages and reasonable legal costs we incur as a result, to the extent the claim is attributable to you. If you are a consumer, this applies only where the claim arises from your deliberate or negligent breach of these Terms, and never beyond what you are responsible for in law.

We will tell you promptly about any such claim, will not settle it without consulting you, and will take reasonable steps to keep the cost down.

If you are a consumer in the European Union, you normally have 14 days to withdraw from a distance purchase without giving a reason.

Premium is a digital service that starts the moment your payment is confirmed. Before paying, you are asked to tick a box confirming that you want it to start immediately and that you accept losing your right of withdrawal once it has been delivered. We record when you gave that confirmation. Without it, the purchase does not go through.

If you withdraw within 14 days having asked for immediate delivery, you owe an amount proportionate to what was supplied up to the moment you told us, and we refund the rest. For a subscription this applies to the billing period in progress — the month or the year you are currently in; cancelling at any other time stops future payments but is not a refund of a period already supplied.

Outside of that, payments for subscriptions, plugins, and sponsored listings are final, except where applicable law requires otherwise or where we have not supplied what you paid for.

Talk to us first. If something is wrong with a payment, contact us before opening a dispute with PayPal or your bank. Almost every dispute we see is a misunderstanding we could have resolved the same day. Raising a chargeback instead does not remove your rights, but it does start a process that costs us a non-refundable fee whatever the outcome.

Where a chargeback or payment dispute is raised without a legitimate basis — for example after the Premium period has been supplied and used, or where the claim of an unauthorised payment is untrue — we may:

• suspend or terminate the account and any Premium features associated with the payment;
• refuse further purchases from that account, Steam ID, Discord account or payment method;
• recover from you, as a debt, the amount charged back plus the dispute fee charged to us by the payment processor and our reasonable costs of dealing with it;
• set off any amount you owe us against any amount we owe you.

Fraud and manipulation. You must not use the Service dishonestly. This includes, without limitation: manipulating votes or rankings by any means; reporting false player counts; operating multiple accounts to evade a restriction; using stolen, borrowed or unauthorised payment credentials; attempting to obtain Premium, discount codes or gifts you are not entitled to; interfering with the Service's security or availability; and misrepresenting who you are.

Where we have reasonable grounds to believe any of that has happened, we may immediately suspend the account, remove listings, cancel affected transactions and withhold Premium time obtained through it, without refund. We will tell you why, and you may challenge the decision by contacting us — we look at it again, and a human makes the final call. Where the conduct appears criminal, or where a payment processor requires it, we may report it and provide the relevant records to the authorities or to that processor.

Discount codes, gifts and free-list access are provided at our discretion, are personal to the account they were issued to, have no cash value and may be withdrawn if abused.

Come to us first. Send a complaint to infotopunturned@gmail.com with your account name and what happened. We acknowledge within 3 working days and aim to resolve within 30 days. Most disputes end here, and doing this first costs you nothing and preserves every right you have.

Out-of-court resolution for consumers. We are not committed to, and are not obliged to use, any particular alternative dispute resolution scheme. That does not take anything away from you: if you are a consumer in the EU you may still refer the dispute to the consumer protection authority or ADR body of the country you live in, and you keep every right to go to court. (The European Commission's online dispute resolution platform closed in July 2025 and is no longer available.)

Nothing is waived. These Terms do not require you to give up the right to go to court, to bring a claim individually, or to use the courts of your own country where the law gives you that right.

These Terms and any dispute arising from them are governed by the law of Greece, and the courts of Greece have jurisdiction.

If you are a consumer, that choice cannot take anything away from you. You keep the protection of the mandatory consumer law of the country you live in. You may bring proceedings against us in the courts of your own country of residence as well as ours, and we may bring proceedings against you only in the courts of the country where you live.

If you are a business user, the courts of Greece have exclusive jurisdiction.

Severability. If any provision of these Terms is found to be invalid, unfair or unenforceable, it is severed or read down to the minimum extent needed, and the remaining provisions stay in full force. An invalid provision does not invalidate the rest of the agreement.

No waiver. If we do not enforce a right straight away, that is not a waiver of it and we may still enforce it later.

Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours to a successor of the business, provided your rights are not reduced; if you are a consumer and that reduces your position, you may terminate and receive a pro-rata refund of anything unused.

Events outside our control. We are not in breach of these Terms, and are not liable, for a failure or delay caused by something beyond our reasonable control — including outages at Discord, Steam, PayPal or our hosting providers, network failures, denial-of-service attacks, changes to the Unturned game, acts of government, or natural events. If such an event lasts more than 30 days and prevents us from supplying Premium you have paid for, either of us may terminate and we will refund the unused portion.

No third-party rights. No one other than you and us has the right to enforce these Terms.

We may change these Terms — for example to reflect a new feature, a change in the law, or a change in what a service costs. The date at the top always shows when they were last revised.

Minor changes that do not affect your rights take effect when published. For any change that materially affects your rights or obligations, or the price of a subscription you hold, we will give you at least 30 days' notice by email or a prominent notice on the site before it takes effect.

If you do not accept a material change, you may stop using the Service and cancel any subscription before the change takes effect. If the change would apply to Premium you have already paid for, you may instead terminate and receive a pro-rata refund of the unused part.

A change never applies retroactively to a purchase already completed, and never to a dispute that has already arisen.
